01Introduction and acceptance

Welcome to LetZDance! These Terms of Service ("Terms") govern your access to and use of the LetZDance mobile application and services (collectively, the "Service"). By accessing or using LetZDance, you agree to be bound by these Terms.

LetZDance is a platform that connects Irish dance schools with students, providing event management, ticketing, and communication tools for the dance community.

02Definitions

• "School" or "School Admin" — Dance schools or instructors who create events and manage students through the platform.
• "Student" or "User" — Individuals who browse events, purchase tickets, and communicate with schools.
• "Event" — Dance classes, workshops, performances, or competitions created by Schools.
• "Platform Fee" — The 6% service fee charged by LetZDance on ticket sales.
• "We", "Us", "Our" — LetZDance and its operators.

03Eligibility

To use LetZDance, you must:

• Be at least 18 years of age.
• Have the legal capacity to enter into binding contracts.
• Provide accurate and complete registration information.
• Not be prohibited from using the Service under applicable laws.

04Account registration and security

4.1 Account creation

To access certain features of the Service, you must create an account. You may register as:

• Student account — to browse events and purchase tickets.
• School Admin account — to create and manage events, manage students, and receive payments.

4.2 Account information

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate and current. You are responsible for maintaining the confidentiality of your account credentials.

4.3 Account security

You are responsible for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account or any other breach of security.

4.4 Email-based authentication

LetZDance uses email-based authentication (magic links) and Google Sign-In. You are responsible for maintaining access to the email address associated with your account.

05Platform fees and payment terms

5.1 Fee structure

When a School sells a ticket through LetZDance:

• Students pay the full ticket price set by the School.
• LetZDance deducts a 6% platform fee from the School's revenue.
• The School receives 94% of the ticket price (minus Stripe processing fees).

5.2 Stripe processing fees

All payments are processed through Stripe. Standard Stripe processing fees apply in addition to the platform fee. These fees are set by Stripe and are subject to change based on Stripe's terms.

5.3 Fee changes

We reserve the right to modify the platform fee structure with 30 days' advance notice to School Admins. Continued use of the Service after such changes constitutes acceptance of the new fee structure.

5.4 No refund of platform fees

Platform fees are non-refundable, even if a ticket is refunded to a student. Schools are responsible for managing their own refund policies with students.

06School Admin responsibilities

6.1 Stripe Connect account

To receive payments, School Admins must:

• Create and maintain a Stripe Connect account.
• Provide accurate business and banking information to Stripe.
• Comply with Stripe's Terms of Service and applicable payment processing regulations.
• Keep their Stripe account in good standing.

6.2 Event creation and management

School Admins are responsible for:

• Creating accurate event descriptions, dates, times, and locations.
• Setting appropriate ticket prices and availability.
• Honouring all ticket sales and event commitments.
• Managing event cancellations or changes in a timely manner.
• Ensuring event promotional images comply with copyright laws.

6.3 Student management

School Admins may:

• View and manage students who have purchased tickets to their events.
• Communicate with students through the in-app messaging system.
• Scan QR codes for event check-in.

6.4 Compliance

School Admins must:

• Comply with all applicable laws and regulations, including data protection laws (GDPR).
• Maintain appropriate licenses and insurance for their dance instruction business.
• Not use the platform for any unlawful or fraudulent purposes.
• Honour their own refund and cancellation policies.

07Student user responsibilities

7.1 Ticket purchases

When purchasing tickets through LetZDance:

• You are entering into a direct agreement with the School hosting the event.
• All sales are final unless otherwise stated by the School's refund policy.
• LetZDance is not responsible for event quality, cancellations, or refunds.
• You will receive a QR code ticket for event check-in.

7.2 Event attendance

Students are responsible for:

• Arriving at events on time with their QR code ticket.
• Following the School's rules and code of conduct.
• Communicating any issues directly with the School through the messaging system.

7.3 Refunds and disputes

For refund requests or event disputes, Students must:

• Contact the School directly through the in-app messaging system.
• Follow the School's refund and cancellation policies.
• Understand that LetZDance does not process refunds on behalf of Schools.

08Prohibited conduct

You may not use the Service to:

• Violate any applicable laws or regulations.
• Infringe on the intellectual property rights of others.
• Transmit harmful, offensive, or inappropriate content.
• Impersonate another person or entity.
• Interfere with or disrupt the Service or servers.
• Attempt to gain unauthorised access to any part of the Service.
• Use automated systems (bots, scrapers) to access the Service.
• Engage in fraudulent activities or payment disputes without merit.
• Harass, abuse, or harm other users.
• Create multiple accounts to circumvent restrictions.

Violation of these terms may result in immediate account termination.

09Intellectual property rights

9.1 LetZDance ownership

The Service, including all software, designs, logos, and content, is owned by LetZDance and is protected by copyright, trademark, and other intellectual property laws.

9.2 User content

When you upload content to the Service (event descriptions, images, messages), you:

• Retain ownership of your content.
• Grant LetZDance a license to use, display, and distribute your content within the Service.
• Represent that you have the right to upload such content and grant this license.
• Are responsible for ensuring your content does not infringe on third-party rights.

9.3 AI-generated images

LetZDance offers an AI image generation feature for event promotional materials. By using this feature:

• You receive a license to use the generated images for your events on the platform.
• You understand that AI-generated content may have limitations regarding copyright.
• You agree not to use generated images in ways that may infringe on third-party rights.

10Data collection and privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

Key privacy points:

• We collect only essential data (email, name, event information).
• We use Stripe for secure payment processing.
• We comply with GDPR and other applicable data protection laws.
• You have rights to access, correct, and delete your data.

11Disclaimers and limitations of liability

11.1 Service "as is"

11.2 No guarantee of availability

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We may suspend or discontinue the Service at any time without liability.

11.3 Third-party services

The Service relies on third-party services (Stripe, Google Maps, email providers). We are not responsible for any failures or issues with these third-party services.

11.4 Event quality

LetZDance is a platform provider and is not responsible for:

• The quality, safety, or legality of events.
• The accuracy of event descriptions or schedules.
• Event cancellations or changes.
• Disputes between Schools and Students.
• Injuries or damages occurring at events.

11.5 Limitation of liability

12Indemnification

You agree to indemnify, defend, and hold harmless LetZDance, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service.
• Your violation of these Terms.
• Your violation of any rights of another party.
• Your content uploaded to the Service.
• Events you create or attend through the platform.

13Termination

13.1 Termination by you

You may terminate your account at any time by:

• Using the account deletion feature in the app settings.
• Contacting us at support@letzdance.org.

Upon termination, your data will be deleted within 30 days in accordance with our Privacy Policy.

13.2 Termination by us

We may suspend or terminate your account at any time, with or without notice, for:

• Violation of these Terms.
• Fraudulent or illegal activities.
• Abuse of the platform or other users.
• Chargebacks or payment disputes.
• Any other reason at our sole discretion.

13.3 Effect of termination

Upon termination:

• Your access to the Service will be immediately revoked.
• School Admins are still responsible for honouring existing ticket sales.
• Outstanding platform fees and Stripe fees remain due.
• Provisions regarding liability, indemnification, and dispute resolution survive termination.

14Dispute resolution

14.1 Informal resolution

Before pursuing formal legal action, you agree to contact us at support@letzdance.org to attempt to resolve any disputes informally.

14.2 Governing law

These Terms shall be governed by and construed in accordance with the laws of Ireland, without regard to conflict of law principles.

14.3 Jurisdiction

Any legal action arising from these Terms shall be brought exclusively in the courts of Ireland.

15Changes to these Terms

We reserve the right to modify these Terms at any time. When we make changes, we will:

• Update the "Effective Date" at the top of this page.
• Notify users through the app or via email for material changes.
• Provide at least 30 days' notice for changes to fee structures.

Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Service.

16Miscellaneous

16.1 Entire agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and LetZDance regarding the Service.

16.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any affiliate or in connection with a merger or sale.

16.5 Force majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, or technical failures.

By using LetZDance, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
